hello. my boys run a limited company.. i am a share holder due to my husband passing on. the lawyers legally took his name off the books but left me as a share holder. now the boys are thinking of bankruptcy....would i be libel for any of the debt.. i have loaned them money in the past...i work for the company as well...
Anon - as a shareholder you should not be liable for any of the debts of a limited company as long as you have not signed any personal guarantees and as long as you are not an officer or director of the company. You should check with the company's legal counsel to make certain.
My husband and I have been
close to the point of filing bankruptcy for the past couple of months. 2weeks ago we received notification from Revenue Canada that we are being audited this summer. If we file bankruptcy before the audit, will any debt that arises from the audit be captured in the bankruptcy? Or do we have to wait until the audit is completed and we find out what we owe before filing?
Anon - a bankruptcy should cover any tax debt owing for the period up to the date of bankruptcy. That having been said, we have in the past seen government departments (not CRA specifically)take a position that a debt did not arise until they did a review and issued a finding post-bankruptcy. I am not sure how successful they were in that position but we did see it being advanced. To avoid that possibility you may, depending on your circumstances, want to wait until the audit is complete and any assessment is issued before filing.

I have been in banking 23 years, recently unemployed, and seeking new opportunities in banking. However, the lapse in unemployment has put me in a position that I am filing for Chapt 7 Bankruptcy. My fear is, Am I bondable by banks in the United States as I am going on an interview soon?
Anon - in Canada we have not seen a problem with individuals who have declared personal bankruptcy obtaining or retaining bonding as long as the bankruptcy is not the result of any breach of a fiduciary role. We cannot comment on the situation in the USA with respect to bonding and banks and recommend that you contact a bankruptcy attorney in the USA to obtain information in that regard.
I am unemployed can I still file for bankruptcy? Also will I lose my two dogs if i file for bankruptcy?

Glen - RESP's are not exempt and the Trustee will have an obligation to obtain the realizable value for the RESPs for the benefit of your creditors. In the past we have often made arrangements for the person to pay the net realizable value into the estate during the period of the bankruptcy.
About 2 years ago I was self-employed but had to close the business. I had about $100,000 in personal unsecured debt at the time, which I was unable to pay since I suddenly had no income. To make ends meet, I took a job overseas that doesn't pay well (pays the monthly bills). I've checked into filing for bankruptcy in Canada, but found that I can't since I'm no longer a resident of Canada. So I've been in default for about 2 years now.
I plan to try to deal with my creditors individually to make some sort of deal once I'm able to. The problem is this: the creditors have my brother's phone number in Canada (which was my last number before I left the country) and they keep making harassing phone calls to my brother's house. All of the creditors know that I'm not in Canada and they all have my phone number overseas (since they've all contacted me here at some point). I think the problem is that whenever my file gets passed on to another agency, none of that information goes with it.
Is there any way that I can force them to stop calling my brother in Canada?
How does the trustee decide on the "garage sale value of your furniture"? I mean, does someone come out and say what you could get for it, do you list what is in your house, or ...? I know you mentioned an auctioneer, but if you are declaring bankrupcty and cannot afford that, what do you do then?

Can a creditor garnish my Manitoba Public Insurance payments?
My boyfriend and I live together and I don't want him to find out that I am filing chapter 7. I rented out my condo for the amount of the mortgage and do not pay any rent living with him. Would I still be able to keep my condo and would I have to tell him I was filing. Would the trustee need anything from him?
How much would fees be to the Trustee to go bankrupt if it is the second time in Bankrupt? Also if a person files their incometax between the pre and post bankruptcy period that is not handled by the Trustee, If there is an amount the bankrupt person gets back, is it considered income to give 1/2 of the amount over your allowable back to the trustee, or can the bankrupt person keep the funds?

I declared bankruptcy 10 years ago. I am mostly self employed and earn less than 20,000 pr year. I have been unable to meet my income tax obligations and now owe approx $25K and counting to CRA. If I declare bankruptcy for a second time, will the income tax debt be forgiven?
My son declared bankruptcy in 2007 but never followed through with his counselling etc.He has now grown up so to speak and would like to resolve this issue. The trustee has closed his case file. What would be his next step to get discharged? Thank you
Anon - if your son is in Manitoba, he has the option of bringing an Appllcation for Discharge himself or having a Trustee in Bankruptcy assist him. The Court of Queen's Bench will provide the necessary forms if he wishes to bring himself. He will have to have his counselling completed and he will have to provide information on his financial circumstances since the time of his bankruptcy. A Trustee in Bankruptcy could assist him to put together the information which the Court would generally require,however, any Trustee will require payment of some amount to assist him.
